This Creative Rights and Ownership Guarantee (the "Guarantee") is a legally binding addendum to the Terms and Conditions of Ball Legacy Publishing House, LLC (the "Publisher") and governs the intellectual property relationship between the Publisher and the submitting author, creator, or copyright holder (the "Author").

1. 100% Retention of Intellectual Property

Ball Legacy Publishing House, LLC explicitly guarantees that the Author retains one hundred percent (100%) of the legal copyright, intellectual property rights, and full ownership of their submitted manuscript, illustrations, and related creative assets. Entering into a publishing, marketing, or distribution agreement with the Publisher does not constitute a sale, transfer, or assignment of the Author's copyright.

2. Complete Creative Control

The Publisher acknowledges that the Author’s work is their unique intellectual property. The Author retains absolute creative freedom and absolute final approval over all editorial changes, cover designs, interior formatting, and marketing materials. The Publisher acts strictly in an advisory and execution capacity to bring the Author’s vision to market.

3. Limited License to Publish

To provide its services, the Publisher requires only a limited, non-transferable license to format, display, print, and distribute the Author's work. The specific scope, duration, and geographic reach of this license will be strictly defined in an individual Publishing Agreement signed by both parties. The Author remains free to license subsidiary rights (such as film, television, or foreign language translations) to third parties independently.

 

4. Financial Independence and Royalties

The Publisher guarantees that it utilizes efficient, modern publishing models that require zero expensive upfront printing costs from the Author. The Author’s royalty structure and payout schedule will remain transparent and entirely unencumbered by hidden inventory or warehousing fees.

 

5. Termination and Reversion of Rights

Because the Author retains full ownership of their work, the Author maintains the right to terminate their individual Publishing Agreement under the terms specified within that contract. Upon termination, any limited licenses granted to Ball Legacy Publishing House, LLC will immediately cease, and all distribution rights will revert fully and exclusively back to the Author without penalty.

6. Protection of Assets

The Publisher agrees to take all reasonable commercial steps to protect the Author’s digital and physical assets from unauthorized distribution, piracy, or theft while those assets are under the Publisher's management.

7. Governing Law

This Guarantee is subject to the laws of the State of Kentucky. Any disputes regarding the ownership, copyright, or creative control of the Author's work shall be interpreted under Kentucky law and applicable federal copyright statutes.
